All orders are subject to our full terms and
conditions (below). Nothing in these conditions affects your
statutory rights as a consumer.
Definitions "Buyer" means the person who buys
or agrees to buy the Products from the Seller (Pine and Oak
Centre). "Conditions" means the terms and conditions
of sale set out in this document and any special terms and conditions
agreed in writing by the Seller."Delivery date" means
the date specified by the Seller when the Products are to be
delivered."Products" means those goods specified."Price"
means the price for the Products including packing and VAT."Seller"
means McFagan Ltd T/A Pine and Oak Centre."Consumer"
shall bear the meaning ascribed in section 12 Unfair Contract
Terms Act 1977.
1. Price
1.1 We reserve the right to cancel the contract between us if:
1.2 The price payable for the Goods shall be as confirmed in
the e-mail, fax or post acknowledgment that we send to you,
in accordance with the provisions of clause 2.1. We reserve
the right to rectify any error. Prices are inclusive of VAT.
1.3 Payment shall be due on acceptance of the order. If you
fail to make payment or if your funds fail to clear, or are
later recalled, we will suspend delivery of the Goods until
payment is made in full
1.6 We have insufficient stock to deliver the Goods you have
ordered;
1.7 We do not deliver in your area;
2. Payment
We accept Visa, Delta, MasterCard, Switch and cheques or postal
orders in pounds sterling as payment for orders. If you pay
by cheque the goods will not be shipped until it has cleared.
You may send your credit card information via phone, fax,
post or over the Internet. If you have any doubt call us on
01825 873607.
2.1 If we do cancel your contract we will notify you by e-mail
and will credit your account by any sum debited by us from
your credit card the same day. We will not be obliged to offer
any additional compensation for disappointment suffered.
2.2 If the Seller does not have sufficient stock to be able
to deliver the goods ordered by the Buyer then any sum paid
by the Buyer will be refunded or re-credited to your account
and the Seller will notify you at the address given by you
in your order form.
3. Delivery
3.1 The Seller shall not be liable for any delay in delivery
howsoever caused.
3.2 If the driver is unable to delivery the goods on the prearranged
day you will be charged for the delivery.
4. Returns
4.1 To check if the item you are ordering is returnable please
call our factory shop on 01825 873607 before you place an
order.
4.2 To cancel an order, we ask that you state this in writing
either by letter or email within 7 days of delivery, quoting
your invoice number and a reason for the cancellation. Please
email: sales@iwantfurniture.co.uk.
4.3 When the goods are delivered, please check carefully
on arrival that the goods and packaging are in good condition.
Please sign the documentation 'received in good condition'.
if you return goods The collection fee for transportation
back to the company is typically £50 refunded if the
goods are faulty.It is essential that you let us know within
7days of any problems or faults with your furniture. We are
unable to help with exchanging or refunding an item after
this time.
Once the items have arrived back to Holmes Hill Furniture
warehouse and found to be in good order, a full refund will
be made.
4.4 When the goods are delivered and show signs of damage
or are defective please mark the delivery note accordingly.
After checking and the goods are found to be damaged either
return the goods with the driver marking the delivery note
that the goods have been returned and email sales@iwantfurniture.co.uk.
with pictures and written details of the damage. Please note
that failure to do this may affect a claim. We must have written
confirmation via email or letter post of any return or exchange
applications.
4.5 You have a right to cancel your order for any item(s)
on this website for a full refund. There is a seven day 'cooling
off' period form the date after you receive your goods.
This does not affect your statutory rights.
4.6 Mattresses can only be returned if they are unopened.
Mattresses which have been opened and slept on cannot be returned.
If you wish to test a mattress please keep it wrapped until
you are sure you want to keep it.
5. Security
5.1 Ordering with us is very secure and if you have any concerns
about security please contact us directly.
6. Website
6.1 Any typographical or clerical or other error or omission
in any sales literature, quotation, price list, acceptance
of offer, invoice or other document or information issued
by the Seller shall be subject to correction without any liability
on the part of the Seller.
6.2 Photographs are for illustrative purpose only, and may
not exactly match the product itself. All measurements shown
on our website are approximate.
7. Governing Law
The contract between us shall be governed by and interpreted
in accordance with English Law and the English Courts will
have jurisdiction to resolve any disputes between us.
8. Entire Agreement
These Terms and Conditions, together with our current web-site
prices, delivery details, contact details and privacy policy
and the conditions of use of our web-site, set out the whole
of our agreement relating to the supply of the Goods by us
to you. Nothing said by any sales person on our behalf should
be understood as a variation of these Terms and Conditions
or as an authorized representation about the nature or quality
of any of the Goods offered for sale by us. Save for fraud
or fraudulent misrepresentation, we shall have no liability
for any such representation being untrue or misleading.
9. Information
We work very hard to make sure information on the Site is
accurate and up to date. Let us know if you find anything
wrong. However, you should check independently any information
before you rely on it. No representations are made by us that
the information is accurate and up to date or complete and
we do not accept liability for loss arising from any inaccuracy
or information that is out of date. This is a website providing
information free of charge.
